This is the original text of WackWall Terms of Use. For general understanding you can also see simplified no-yada-yada version. Remember though, when you sign up you agree to be bound by the original agreement below so it's a good idea to actually read and understand its details.
The Company - Skalfa eCommerce, the owner of WackWall service and OpenWack (software platform behind it).
WackWall - the free web service for online social network websites creation and use.
Social networks, networks – interconnected web sites powered by WackWall and filled with users’ content. Social networks may be created by anyone having a free WackWall ID and are hosted by WackWall.
WackWall ID - a free user account on WackWall valid for networks powered by it.
Users:
Content – the material consisting of data, pictures, multimedia files, texts, comments, notices, files, messages, press releases, datasheets, FAQs, communications,any other materials transferred via the WackWall service or via any network. All Content provided by WackWall is referred to as “WackWall Content”. All user-supplied Content is referred to as “User Content” and stored on the Company’s servers. Users take all the responsibility for the uploaded content.
Skalfa eCommerce (further The Company) provides you with a free online web service WackWall subject to these terms of use (further The Terms). By using WackWall in any way including sign up for a free account, networks’ creation, posting and sharing Content or merely browsing Social Networks, you agree to and are bound by the terms of use set forth and in any changes in this document. If you do not agree to these terms of use, please do not access or use this web service. Although we are most likely to cover substantial changes in this agreement on our blog, these terms of use may be periodically updated without prior notice please check the most recent version of the terms of use using the link on the main page of WackWall at any time. You need to render your user profile and social network(s) compliant with these terms within 7 days after publication.
The Company provides users with the ability to create own social networking web sites by getting a unique WackWall ID. The WackWall ID can be used for the creation new networks or for the access existing networks and any communication tools, changing the look of the created networks by default layouts, upload and posting your authorship works, pictures, multimedia files, texts, messages. Users agree that the company may add any advertisements on users’ networks and understand that is necessary condition for providing this service. The company may use users’ personal information given in profiles for communications and newsletters announcements and users cannot opt out this right.
We do not sell or expose your contact information to any 3rd parties. We may use your contact information to make important notifications and let you know how you can improve your experience with WackWall.
WackWall does not claim any ownership rights for content and user profiles created by users of your social network(s). You can obtain a backup of this data from us anytime by contacting us.
You agree to hold full responsibility for publishing any content on any WackWall network(s) including yours. WackWall cannot be held directly or indirectly responsible for publishing illegal content by WackWall users on any WackWall networks.
WackWall is a service generally created to encourage freedom of speech. We support it with important responsibility rules.
If you take a WackWall-powered social network as a standalone independent website with users' ability to contribute content (this is generally what it is) the whole picture boils down to common sense.
The Company behind WackWall is established in the USA, Czech Republic and Kyrgyzstan. Thus illegal content is what prohibited by law of these three countries and by law of the country(ies) of your residence/citizenship. Illegal content includes but is not limited to
and such.
There are no circumstances under which any social network powered by WackWall can temporarily or permanently host illegal content. If you as a WackWall user see examples of posting illegal content you agree to report this to the social network owner and/or WackWall webservice staff.
We also encourage you to avoid generating/hosting questionable content like hate-speech, propaganda, and such. Although this is not being treated illegal we reserve right to discontinue our relationships with social networks that we believe may hurt user experience.
The WackWall service is provided as is and the Company takes not responsibility for any damages, deletion, failure to store any user communications or personal settings. This service comes ”as is” without guarantees of uptime or features work. We do strive to preserve the maximum possible uptime and limit unavailability to scheduled updates and maintenance yet you understand that WackWall is a free service.
WackWall cannot be held responsible for any direct or indirect damage that may be caused by your usage of WackWall webservice for creating your own social network(s) and/or participating in social network(s) created on and hosted by WackWall.
WackWall cannot be used for emergency communication. For that purpose you may want to consider other services.
The Company reserves the right to restrict, disable, block, suspend or terminate your access to the WackWall service at any time without prior notice or liability to you. In a normal situation we always try to establish communication before taking actions of this kind but we leave it to our own discretion not to do so in something-terribly-wrong-here cases.
