Changes to the SkaDate EULA

Skalfa eCommerce informs its customers about minor changes made to the SkaDate EULA.
There were 4 changes made to the EULA for SkaDate Software Solution.
First change concerned modifications to the EULA by the company. New addition added to the clause 1.1. : “Customer shall have the right to object to any such changes, in which case this agreement shall remain as currently drafted.” The new version of this clause is:
“1.1. The Company reserves the right to change the terms, conditions, notices under which the Software Solution Package is offered, and inform the Customer beforehand the changes would come into effect, in this instance 5 business days by email. Customer shall have the right to object to any such changes, in which case this agreement shall remain as currently drafted.”

Next change concerned the hot question on additional installations of the software solution. Added to 2.3. clause : “…or installations are made for testing or backup purposes.” Now customers may have multiple installations of the software solution for testing and backup purposes. The new version of this clause is:
“ 2.3. If you install additional copies, even if such additional copies are located on the same domain and/ or the same IP, such usage is prohibited unless additional licenses are purchased or installations are made for testing or backup purposes. ”

Another change applied to customers’ ownership rights. Added to the clause 3.1. “but bear all the rights and responsibilities for it on yourself. You will have ownership rights to all information collected, obtained, created and/or stored via or in your website.” The new version of this clause is:
“3.1. You are granted a single, non-exclusive, non-transferrable license to install and use one copy of the Software Solution Package on a single domain name or IP address.
You own the rights to advertise or offer, to sell or buy any goods or services for any business purpose, publish post, upload, distribute or disseminate, sell any material or information through your web site, but bear all the responsibility for it on yourself. Create and sell memberships and other materials and information posted on your website. You will have ownership rights to all information collected, obtained, created and/or stored via or in your website. ”

And the last change applied to the collection of the information by the company. Added to the clause 8.4. “The Company will not collect any information from your customers in your website.” The new version of this clause is:
“8.4. The Company may combine and use personal information collected from you at different times to improve its services by sending email newsletters, or sending printed materials to your home. The personal information will not be shared with third parties. The Company will not collect any information from your customers in your website.”

There were 2 changes made to the EULA for SkaDate Managed Solution:
The same changes to the clauses 1.1. and 8.4.

SkaDate: minor EULA changes

We made a few additions to SkaDate EULA’s for both Software and Managed solution. Summary:

Managed and Software solution EULA:
8. How we use information about you.

These additions reflect common sense and are usually figured out on skadate.com website materials and via communication with customers. Thanks to one of our prospects, they are now in the EULA as well, effective from this moment.
